Terms of Service

These Terms of Service (“Terms”) govern services provided by Reliable Pool Care (“Reliable Pool Care,” “we,” “us,” or “our”) to customers receiving services in the State of Florida.

By requesting, scheduling, approving, or receiving services from Reliable Pool Care, or by accepting an estimate, quote, service agreement, work order, or invoice, you (“Customer” or “you”) agree to these Terms.

1. Services

Reliable Pool Care provides residential swimming pool maintenance services, which may include:

  • Routine pool cleaning and maintenance
  • Water testing and chemical balancing
  • Pool chemical treatments
  • Filter cleaning and maintenance
  • Green pool treatments and turnarounds
  • Drain and clean services
  • Visual observation of pool equipment as it relates to routine pool maintenance
  • Other pool maintenance-related services agreed upon between Reliable Pool Care and the Customer

The specific scope, frequency, and price of services may be established through a service agreement, approved quote or estimate, work order, invoice, customer portal, or other written communication.

These Terms apply to pool maintenance and cleaning services and do not cover pool equipment repair or installation services.

2. Customer Responsibilities

Customers are responsible for providing Reliable Pool Care with reasonable and safe access to the pool, pool equipment, and other areas necessary to perform scheduled services.

Customers agree to:

  • Provide accurate contact and property information.
  • Maintain reasonable access to the property on scheduled service days.
  • Ensure gates, locks, pets, landscaping, and other conditions do not prevent safe access.
  • Inform Reliable Pool Care of known equipment problems, hazards, or unusual pool conditions.
  • Maintain an adequate pool water level unless otherwise instructed.
  • Maintain functioning pool equipment necessary for normal circulation and sanitation.
  • Notify Reliable Pool Care of changes that may affect service.
  • Inform Reliable Pool Care of construction, landscaping, pressure washing, roofing, parties, unusual swimmer loads, or other circumstances that may substantially affect pool conditions.

If our technician cannot safely access the property, pool, or equipment because of a condition within the Customer's control, the scheduled visit may still be considered a completed service visit for billing purposes.

3. Service Scheduling

Routine pool maintenance is generally performed according to an established service schedule.

Exact arrival times are not guaranteed unless Reliable Pool Care specifically agrees in writing to a timed appointment.

Service schedules may change because of:

  • Weather
  • Holidays
  • Staffing
  • Equipment issues
  • Emergencies
  • Route adjustments
  • Traffic
  • Unsafe conditions
  • Other circumstances reasonably affecting our ability to perform service

Reliable Pool Care may perform service on a different day when reasonably necessary while continuing to provide the agreed service frequency.

4. Florida Weather and Uncontrollable Conditions

Florida weather and environmental conditions can significantly affect swimming pools.

Heavy rain, tropical storms, hurricanes, flooding, lightning, excessive heat, wind, excessive debris, algae growth, power outages, water restrictions, construction, landscaping, equipment failures, and other circumstances outside Reliable Pool Care's reasonable control may affect pool conditions or our ability to provide normal service.

During unsafe weather conditions, including lightning, severe storms, tropical weather, or other hazardous conditions, some or all portions of a scheduled service may be postponed, modified, or limited for employee safety.

Reliable Pool Care does not guarantee that normal pool conditions can be maintained during or immediately following severe weather, equipment failure, extended power outages, flooding, or other conditions outside our reasonable control.

Additional cleanup, chemical treatment, storm cleanup, green-pool treatment, or corrective maintenance may result in additional charges when authorized by the Customer.

5. Estimates, Quotes, and Additional Maintenance

Quotes and estimates are based on conditions reasonably known at the time they are prepared.

Additional pool maintenance needs may be discovered after work begins.

If additional cleaning, chemicals, treatments, or materials are necessary beyond the approved scope, Reliable Pool Care may provide an updated estimate or request additional authorization before proceeding.

Customer approval may be documented through:

  • An electronically signed quote or estimate
  • Email
  • Text message
  • Customer portal
  • Electronic approval
  • Other written authorization

Approved services, chemicals, treatments, and materials are the financial responsibility of the Customer.

6. Pool Chemicals

Routine service may include chemicals according to the Customer's selected service plan.

Pools requiring unusually large quantities of chemicals because of algae, contamination, excessive debris, heavy swimmer activity, water loss, equipment failure, neglected maintenance, severe weather, flooding, construction, landscaping, or other unusual conditions may require additional treatment and charges.

Reliable Pool Care cannot guarantee specific chemical usage because every pool's water chemistry, environmental exposure, equipment, and operating conditions are different.

7. Existing Equipment and Property Conditions

Reliable Pool Care is not responsible for failures or damage resulting from:

  • Pre-existing conditions
  • Normal wear and tear
  • Defective or improperly installed equipment
  • Corrosion
  • Age
  • Manufacturer defects
  • Underground plumbing problems
  • Electrical problems
  • Structural defects
  • Customer modifications
  • Work performed by other contractors
  • Conditions outside Reliable Pool Care's reasonable control

Pool equipment can fail without warning even when properly maintained.

During routine pool maintenance, technicians may observe apparent equipment problems and notify the Customer. Any such observation is provided as a courtesy and is not intended to constitute a professional equipment inspection, diagnosis, repair recommendation, or guarantee regarding the condition of the equipment.

The Customer remains responsible for arranging any necessary equipment diagnosis or repair with an appropriately qualified service provider.

8. Payment Terms

Customers agree to pay all amounts due for maintenance services, chemicals, treatments, materials, and other authorized charges covered by these Terms.

Unless otherwise stated in writing:

  • Invoices are due upon receipt.
  • Customers receive a 15-day grace period before a late fee is assessed.
  • Accounts remaining unpaid after the grace period may be assessed a 5% late fee, to the extent permitted by applicable law.
  • ACH payments may be subject to a 1% processing fee, where permitted by applicable law and applicable payment-network requirements.
  • Payments made by check are not subject to a payment processing fee.
  • Reliable Pool Care will not impose a credit-card surcharge where prohibited by Florida law.

Returned checks, rejected ACH payments, reversed transactions, chargebacks, or other failed payments do not eliminate the Customer's responsibility for the underlying balance when the charge was legitimately owed.

Reliable Pool Care reserves the right to suspend service on accounts with past-due balances.

9. Automatic Payments

Customers enrolled in AutoPay authorize Reliable Pool Care and its payment processor to charge the payment method maintained on the Customer's account for authorized invoices and amounts due.

Invoices will generally be provided before an automatic payment is processed.

Customers are responsible for maintaining current and valid payment information.

Requests to remove or change an AutoPay arrangement should be submitted at least 10 days before the first day of the applicable billing period to allow sufficient processing time.

AutoPay authorization concerns the method of payment and does not, by itself, create or extend the term of a recurring service agreement.

10. Recurring Services and Automatic Renewal

Routine pool maintenance may be provided on a recurring basis according to the Customer's service agreement.

If a written service agreement contains an automatic-renewal provision, the renewal terms will be clearly disclosed as required by applicable Florida law.

Where Florida law requires advance notice of an upcoming automatic renewal, Reliable Pool Care will provide the required written or electronic notification within the legally required timeframe.

Where applicable, Customers will be permitted to cancel an automatically renewing service agreement using the same manner and means by which the Customer accepted the agreement.

Nothing in this section eliminates amounts already owed for services performed, chemicals supplied, or other authorized maintenance-related charges.

11. Cancellations and Changes to Service

Customers wishing to cancel recurring pool service should provide Reliable Pool Care with reasonable written notice.

Cancellation may be submitted through a method made available by Reliable Pool Care for cancellation and, where required by Florida law, through the same manner and means used to accept an automatically renewing service agreement.

Any outstanding balance for services already performed, chemicals supplied, materials provided, or other authorized charges remains due following cancellation.

12. Missed or Inaccessible Service Visits

If Reliable Pool Care arrives for a scheduled service and cannot access the pool or equipment because of:

  • A locked gate
  • An unsecured animal
  • Construction
  • Landscaping
  • Property conditions
  • Access-code problems
  • Another condition within the Customer's control

The visit may be considered completed for billing purposes.

Reliable Pool Care is not responsible for deterioration in pool conditions resulting from an inability to access the property.

13. Pets and Animals

Customers are responsible for securing pets and other animals before a technician enters the property.

Reliable Pool Care may decline to enter or remain on a property when an animal presents a potential safety concern.

Any resulting missed service may be treated in accordance with the inaccessible-service provisions of these Terms.

14. Customer Communications

Customers agree that Reliable Pool Care may contact them regarding:

  • Scheduled appointments
  • Service updates
  • Pool conditions
  • Estimates and quotes
  • Invoices and payment information
  • Observed equipment concerns
  • Account matters
  • Customer service requests

Communications may occur by telephone, email, text message, customer portal, or another contact method provided by the Customer.

Marketing text messages will be sent only where permitted and with any consent required by applicable law.

Consent to receive marketing text messages is not required to purchase Reliable Pool Care services.

15. Service Documentation

Reliable Pool Care may document services performed through:

  • Technician notes
  • Chemical readings
  • Photographs
  • Timestamps
  • Digital service reports
  • Pool and equipment observations
  • Service history
  • Customer communications
  • Other reasonable business records

Photographs taken for service documentation are intended to document pool or equipment conditions and work performed.

Reliable Pool Care will handle personal information in accordance with its Privacy Policy.

16. Service Results

Reliable Pool Care will use reasonable efforts to maintain appropriate pool conditions based on the services purchased.

Pool conditions can be affected by weather, swimmer activity, landscaping, debris, animals, water quality, equipment failures, power outages, water level, customer actions, construction, storms, and other circumstances outside Reliable Pool Care's reasonable control.

Accordingly, Reliable Pool Care cannot guarantee that a pool will remain completely free of algae, debris, staining, equipment problems, or changes in water chemistry at all times.

A pool requiring corrective treatment because of circumstances outside normal weekly maintenance may require additional services and charges.

17. Limitation of Liability

To the extent permitted by applicable law, Reliable Pool Care will not be responsible for indirect, incidental, special, or consequential damages arising from circumstances outside its reasonable control.

Reliable Pool Care is not responsible for damage resulting from pre-existing defects, concealed conditions, equipment failure unrelated to our maintenance services, acts or omissions of other contractors or property owners, severe weather, flooding, power interruptions, or other circumstances outside our reasonable control.

Nothing in these Terms is intended to waive, disclaim, or limit any right, remedy, duty, or liability that cannot legally be waived or limited under Florida or federal law.

18. Disputes, Billing Questions, and Chargebacks

Customers should notify Reliable Pool Care promptly if they believe an invoice, payment, service visit, chemical charge, or other account activity is incorrect.

Customers are encouraged to contact Reliable Pool Care directly so that we have an opportunity to review technician records, photographs, communications, approvals, invoices, and other service documentation and attempt to resolve the matter.

Submitting a payment dispute or chargeback does not automatically cancel amounts legitimately owed for authorized maintenance services, chemicals, treatments, or materials provided.

Reliable Pool Care reserves the right to provide relevant service records, approvals, photographs, communications, and transaction documentation to payment processors, financial institutions, or other parties reasonably involved in resolving a payment dispute.

19. Suspension or Termination of Service

Reliable Pool Care reserves the right to suspend or discontinue service when reasonably necessary, including for:

  • Nonpayment
  • Repeated failed payments
  • Unsafe property conditions
  • Harassment, threats, or abusive behavior toward employees
  • Repeated inability to access the property
  • Unauthorized interference with pool maintenance services
  • Conditions creating unreasonable risk to employees
  • Material violations of these Terms

Any unpaid balance remains due following suspension or termination of service.

20. Changes to Pricing or Service

Reliable Pool Care may periodically change its service pricing, service plans, chemical charges, or other maintenance-related charges.

Customers will be provided notice of material pricing changes applicable to their recurring service before the new pricing becomes effective when required by applicable law or the applicable service agreement.

Continued service following an effective pricing change may constitute acceptance of the new pricing to the extent permitted by applicable law and the applicable service agreement.

21. Changes to These Terms

Reliable Pool Care may update these Terms periodically to reflect changes in services, business practices, pricing policies, payment requirements, or legal requirements.

Updated Terms will be posted or otherwise made available with a revised “Last Updated” date.

Changes will apply prospectively to the extent required by applicable law.

22. Florida Governing Law

For services provided in Florida, these Terms will be governed by applicable federal law and the laws of the State of Florida, without regard to conflict-of-law principles and without limiting consumer rights that cannot legally be waived.

Nothing in these Terms is intended to avoid or supersede mandatory Florida consumer-protection requirements.

23. Severability

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

The affected provision will be enforced to the maximum extent legally permissible.

24. Entire Service Terms

These Terms, together with any applicable service agreement, accepted estimate or quote, work order, AutoPay authorization, and other written terms specifically applicable to the Customer's services, constitute the terms governing the applicable services.

If a separately signed service agreement expressly conflicts with these general Terms, the more specific written provision will control to the extent permitted by applicable law.
